RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS, AGREEMENT, AND ASSUMPTION OF RISK

WHEREAS, in consideration of being permitted to attend a course for instruction in firearms, for the instruction in firearms, for use of premises, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Undersigned (hereinafter referred to as “Participant”), acknowledges and agrees to the following:

Participant agrees to indemnify, hold harmless and defend 10-8.blue LLC dba Lascrucesccw.com, a limited liability company domiciled in the State of New Mexico (hereinafter referred to as "Instructor"), and it’s assigns (including, but not limited to, members, owners, officers, agents, guest instructors, contractors, and all other persons and entities assisting it or acting on its behalf, also hereinafter included as “Instructor”) from any and all fault (including but not limited to acts and omissions of negligence), liabilities, costs, expenses, claims, demands, or lawsuits arising out of related to or connected with: Participant; Participant’s presence on or use of the classroom and classroom facilities, range, building, land, and premises("Premises"); and, any and all acts or omissions of Participant. This obligation of indemnity includes the obligation to hire and pay for attorneys, chosen by Instructor in its sole discretion, to represent and/or defend Instructor, including paying any advance fee, retainer, or deposit requested by such attorneys. Participant acknowledges and understands the inherent risk of training with firearms and that serious injury, disability, or death will likely occur if shot. Participant understands that Instructor may be teaching beginners who have never handled a firearm before and assume the risk of injury by participating in the training.

Participant furthermore waives for himself/herself and for his/her executors, personal representatives, administrators, assignees, heirs and any next of kin; any and all rights and claims for damages, losses, demands and any other actions or claims whatsoever, which he/she may have which may arise against Instructor (including but not limited to the death of Participant and /or any and all injuries damages or illnesses suffered by Participant or Participant's property), which may, in any whatsoever arise out of, be related to or be connected with: the course of instruction; the Premises, including any latent defect in Premises; Participant; presence on or use of said Premises; Participant's property whether or not entrusted to Instructor); and the discharge of firearms.

Instructor shall not be liable for, and Participant, on behalf of himself/herself and on behalf of his/her executors, personal representatives, administrators, assignees, heirs, and next of kin, hereby expressly releases the Instructor(s) from any and all such claims and liabilities. Should a dispute arise between Participant and another participant, or if another participant is involved in injuring Participant, Participant agrees to resolve the dispute/injury/death directly with the other participant and binds his/her executors, personal representatives, administrators, assignees, heirs and any next of kin to do the same. Participant expressly agrees that Participant’s (including his/her executors, personal representatives, administrators, assignees, heirs and next of kin) sole exclusive legal remedy shall only be against other participants, and not Instructor.

Participant hereby expressly assumes the risk of taking part in the course for instruction in firearms and taking part in the activities on the Premises, which include, but are not limited to, instruction in the use of firearms, the discharge of firearms and the firing of live ammunitions.

Participant agrees to always keep their weapon pointed in a safe direction.

Participant agrees to immediately report to Instructor anyone who is unsafe, and anything that is unsafe, and that the failure to report is prima facie evidence that Instructor did not have knowledge of any unsafe behavior or condition.

Participant warrants they are fit and free from conditions that could cause adverse medical issues and injuries.

Participant warrants they will stay hydrated and monitor weather conditions and seek medical attention if feeling ill. Participant agrees to be responsible for any adverse situations or conditions that adverse weather may cause Participant to suffer. Participant may, at any time, leave the class prior to class completion and retake the next class without charge, if the Participant feels ill or otherwise believes that that the weather is not suitable for Participant to complete the class. Participant agrees that Instructor is not responsible for any weather-related situations or conditions that may be averse to Participant.

Participant agrees that instructor is not required to medically treat participant for any injury, great or slight. Further, participant voluntarily consents to medical treatment, and agrees that no battery is being committed, should instructor decide to treat participant for an injury.

Participant warrants that all equipment and weapon(s) they bring are in good working order and that all ammunition they use is suitable for the weapon(s) they are using and in good condition, and that at least one weapon is at least .32 caliber, if taking the concealed carry class.

Participants agree not to bring weapons into the classroom and that weapons will remain unloaded at the range until instructed to load weapon(s) by Instructor. Once loaded, weapon(s) shall remain in a suitable holster until actually fired on the range when instructed.

Participant warrants that they are a Citizen of the United States or Permanent Legal Resident of the United States.

Participant warrants they are a resident of New Mexico or a member of the armed forces whose permanent duty station is located in New Mexico or a dependent of such a member, in order to receive a New Mexico concealed carry license. New Mexico residency is not required for the AZ or Fl concealed carry licenses.

Participant warrants that they are 21 years of age or older if taking the concealed carry class, to receive a certificate. If younger than 21, Participant understands that they will not receive a concealed carry certificate, will not participate in shooting at the range, and are taking the class for educational purposes only.

Participant warrants that they have not been convicted of a felony in New Mexico or any other state or pursuant to the laws of the United States or any other Jurisdiction.

Participant warrants that they are not otherwise prohibited by federal law or the law of any other jurisdiction from purchasing or possessing a firearm

Participant warrants that they have not been adjudicated incompetent or committed to a mental institution.

Participant warrants that they are not an unlawful user of or addicted to any controlled substances and / or alcohol.

Participant warrants that they have not received a conditional discharge, a diversion or a deferment, or been convicted of, pled guilty to, or entered a plea of nolo contender to a misdemeanor offense involving a crime of violence within the last 10 years.

Participant warrants that they have not within the last 5 years been convicted of a misdemeanor offense involving driving while under the influence of an intoxicating liquor or drugs.

Participant warrants that they have not been convicted of a misdemeanor offense involving the possession or abuse of a controlled substance within the last 10 years.

Participant warrants that they have not been convicted of a misdemeanor offense involving assault, battery, or battery against a household member.

Participant warrants that they are not a fugitive from justice.

Participant warrants that they have never renounced United States Citizenship.

Participant acknowledges and agrees that this instrument was available on Instructor’s website to read prior to the class being purchased, even if Participant signed it at a later time.

Participant understands that Instructor is teaching this class in a private capacity and not in any official capacity for any law enforcement agency, even though instructor may work for a law enforcement agency.

Participants who believe they meet the definition of Qualified Retired or Separated Law Enforcement Officer who are taking the LEOSA qualification warrant that they meet all requirements in LEOSA to carry a firearm and are residents of New Mexico.


Participant understands that all provisions of this instrument are material and Participant agrees that this release of Instructor liability is a material condition for Instructor to teach the class to Participant, and that were Instructor not released from liability as set forth in this instrument, Instructor would not have allowed Participant to be present or participate in the firearms training class.

Participant hereby acknowledges and agrees that Participant has read this instrument and understands its terms and is executing this instrument voluntarily. Participant furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all range rules and procedures and any other rules and procedures stated by Instructor. Participant hereby certifies that participant has had ample time to read each paragraph of this instrument carefully and thoroughly and that it was provided in advance of the class so that it’s terms could be carefully researched and studied before signing.

Participant expressly agrees that this instrument is intended to be as broad and inclusive as permitted by law, and that if any provision of the instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. No remedy, and each and every remedy shall be cumulative and shall be in addition to every other more remedy here under by the Instructor(s) shall not constitute any waiver of Instructor's right to pursue other available remedies. This instrument binds Participant and his/her executors, personal representatives, administrators, assignees, heirs, and next of kin.
